How To File A Grievance

What is a grievance?

In a labor union, a grievance is the subject of a complaint filed by an employee to be resolved by procedures provided in the Collective Bargaining Agreement.  Or simply stated  a grievance is simply defined as a violation of our Agreement.

What are the most common grievances?

The only sure means of enforcing our Collective Bargaining Agreement is to timely file and progress Claims in accordance with the respective Rules of the Agreement.   The TCU constitution gives every member the right to file and progress a claim in their own behalf, however, it is strongly recommended that the Chairman of the Local Protective Committee (Local Chairman) file all Claims to ensure that Claims are progressed in a proper and timely manner.

What do I do if I think a rule violation has occurred?

Someone gave me a form to file out for time claims, Is this form valid?

No. Our members fall under different union contracts. The rules are different for each one. If you have any questions or need any assistance, please contact Local Chairman of the Protective Committee.

How to file a grievance?

Grievances have to be filed in a certain format. Click here for a sample claim. Claims must be filed with the proper person. Please contact the Local Chairman of the Protective Committee to get updated address information. We strongly recommend that ALL claims be filed through the Local Chairman of the Protective Committee.  In accordance with the TCU constitution, the Claimant must present ALL of the relevant facts to the Local Chairman of the Protective Committee as soon as there is knowledge of a violation of the agreement. You can send a hard copy in the mail by downloading and mailing this Grievance Form or by submitting in the below form. By submitting the below form you are sending the information to the Local Chairman of the Protective Committee for processing. Please know that Claims have to be submitted in proper form within sixty “60” days from the date of violation.  Your Claim will be researched filed as soon as possible.
